Kesilapan vs Kebodohan

Pagi tadi aku terima sms daripada Sasha. Dia minta aku baca belog seorang kenalan di uni dulu, dan minta aku berikan komen.

Kenalan ni, bukanlah kawan aku di uni pon. Hanya kenal susuk dan nama. Lepas tamat belajar, dia sertai sistem kehakiman. Mula2 jadi Penolong Kanan Pendaftar, lepas tu jadi Majistret, lepas tu dengar2 dia sudah ke Mahkamah Persekutuan. Tak tahulah apa jawatannya di sana. Tahniahlah.

Tapi bukan itu yang aku pedulikan.

Aku tak peduli kau siapa, kerja dengan siapa, anak siapa, pointer kau di uni berapa, kau kahwin dengan siapa, betapa susah kerja kau, kau kenal siapa... semua tu tak penting.

Tapi JANGAN kutuk profesyen guaman tanpa usul periksa. JANGAN panggil rakan-rakan peguam bodoh tanpa tahu cerita sebenar. JANGAN tuduh peguam makan duit klien atas kebodohan.

Antara isi-isi kandungan belognya begini:-

"Kalau dah salah tulis nama, macam mana judge tu nak approve lu punya order kan? Please do not expect the staff to correct your drafts as it is not their duty to do so. The current instruction is to return any flawed draft orders. Why burden the staff to do what the lawyers are supposed to do for their clients (and collecting fees for such work)? Not fair isn’t it?
And don’t come back to tell the Court that nobody is perfect. We don’t care whether you are perfect or not. But your draft order must be perfect before we process it.."

Tuan yang bijaksana, memang kesilapan kecil kadang-kadang adalah merimaskan. Tapi deraf dipanggil deraf adalah bersebab. Tujuan deraf adalah untuk mengelakkan terdapatnya kesilapan di salinan yang bersih. Kalau deraf tu dah sempurna dan difailkan, kita panggil ia 'salinan bersih yang telah dimeterai". Tak ada peraturan hatta di dalam Kaedah-kaedah Mahkamah sekalipun yang mewajibkan deraf pertama yang diserahkan kepada Mahkamah supaya sempurna 100%. Kami tak pernah berniat nak menyusahkan staf Mahkamah. Tapi bukankah ia sebahagian daripada bidang kerja mereka?

"Another thing is this. How many of the private sector lawyers know the differences between a Senior Assistant Registrar, Deputy Registrar, Senior Registrar of the Session / Magistrate Courts, Magistrate, Chief Clerk and Pembantu Tadbir Undang-undang?
I must admit that when I started service, I didn’t much about these designations. But as soon as I started working, I realized how important it is to know the hierarchy of these designations and the jurisdiction that comes with it. So I learned the duties of each designation. I doubt if you can get it in any books but asking around sure helps.."

Tuan yang bijaksana, saya tak tahu apa yang mereka ajar di sistem kehakiman, tapi para peguam dah belajar semua ni masa jadi pelatih dalam kamar. Ooops pensyarah -pensyarah Civil Procedure dan Professional Practice saya pun pernah sebut perkara ni. Tuan tidoq dalam kelas kaa?

"If you are told by a clerk that your file is missing, how many of you would just go back to your office and tell your client that your case was postponed because the file is missing and how many would go and ask either the SAR / DR regarding the accurate status of the file?
Most of the complaints of missing files that reaches the Palace Of Justice were not even missing. Upon investigation, it shows that the lawyer did not check with any officer and just took the word of the interpreter or clerk that the “file takda!”. They don’t even know that they should go to the Registrar / SAR / DR when there is any problem relating to the administration of their files / cases. They don’t even know what in the world is Registrar / SAR / DR what more who these individuals are! And then they have the cheek to inform their client that the court misplaced the file and it is now missing!
Sedih… tapi benar…."

Tuan, sememangnya ia akan menjadi lawak minggu ini sekiranya saya pergi berjumpa dengan Penolong Kanan Pendaftar atau Timbalan Pendaftar untuk mengadu kepada mereka bahawa fail saya hilang. Ini adalah kerana di dalam bangunan Mahkamah yang tersergam indah itu, terdapat sebuah bilik kecil yang dinamakan Bilik Fail. Apa yang saya cuma perlu lakukan apabila jurubahasa beritahu saya bahawa fail saya tidak ada ialah pergi ke kaunter pendaftaran atau Bilik Fail, berjumpa dengan pegawai yang bertugas, beri nombor fail dan butiran fail dan pegawai yang bertugas akan periksa buku log dimanakah fail tersebut berada. Sekiranya sempat, fail dapat diperoleh hari itu juga dan kes akan berjalan seperti biasa. Jika tidak, memang wajarlah tarikh baru diberikan walaupun hati ada rasa sedikit bengang. Adakalanya, fail memang tidak dapat dijumpai atas sebab-sebab berikut:-

i. Mahkamah berpindah bilik/bangunan
ii. Kes sudah ditutup
iii. terdapat beberapa pendengaran interlokutori- kadang2 fail ada dengan PKP, kadang2 dengan Hakim.

Tuan, hal2 sebegini tidak ada kena-mengena dengan sistem hierarki Mahkamah. Para peguam sudah cukup independen untuk mencari semula fail mereka yang hilang selagi terdaya. Saya berani potong jari bahawa sekiranya saya pergi perjumpa dengan PKP atau TP untuk mengadu tentang fail saya yang hilang, mereka akan bertanya semula kepada saya "DAH BUAT FILE SEARCH?"

"So my suggestion is this.
Go and learn the roles and responsibilities of Judicial Officers. You must know the right person to refer if you are in trouble. It is extremely important that you know this piece of knowledge if you want to be able to fulfill your duties to your client. If I had a lawyer, and my lawyer kept telling me that my file in court is missing, I’d be damned pissed. I’d be even more pissed if I knew that my lawyer didn’t do anything to check with the appropriate officer the actual status of my file.."

Tuan yang bijaksana, sekiranya saya bertemu dengan klien yang sebegini, saya akan membawa beliau menziarah Mahkamah yang Mulia dan dia boleh teman saya buat "file search' kalau dia nak.

Nampaknya bukan sahaja peguam 'tidak sempurna', tapi Tuan juga sudah terkhilaf dari segi fakta, pengalaman dan sikap suka menuduh tanpa usul periksa akhirnya akan memakan diri kita sendiri.

im a lawyer. and i wonder. what is with your temper ek? u r quite hateful tau. i know some court officials kerek nak hentam lawyers, lawyers pon ada rasa bagus gak, everything and anything govt official did salah. we all are human. to err is human. we accept it, and we move on. jangan kusutkan kepala. and this is not just based on this entry, but most of your entries. i selalu nampak u from far, i tak berani nak tegur. coz of ur temper/sensitif. u need to chill. i do both criminal and civil. so, dah cemacam hakim i jumpa. ada yang bagos, ada yang lembap. standard la. lawyers pon sama je. ada yang pro, ada yang drama queen/king. too emotional over their matters sampai takleh nak draw the line. im a guy btw. this is a friendly advise. ur pretty, but, quite intimidating.

im a lawyer too, btw im a woman and there is nothing emotional about this entry. She is just stating the facts, the obvious facts.

Mmg kedua-dua pihak, mahkamah dan peguam ada masalah tersendiri, tetapi bila satu pihak menunding jari tanpa usul periksa, dan men"ridiculed" pihak yg lain dengan niat untuk memperkecilkan integriti para peguam, ia adalah menjadi tanggunjawab si penulis atau saya untuk menegakkan kebenaran.

woo hoo..pretty and intimidating - what a fatal combination..so woman if you speak your mind - its temper and emotional but if men says anything - they are being bold and assertive..get over it lah megat..this is 2010

i am a lawyer too (non practising).

and i have no problem at all with this entry. i have once encountered with this situation where that particular kept missing in court. i did file search on it. went to see pkp and informed abut the missing file. guess what was the reply from the so learned pkp?

"pasal file hilang pun awak nak tanya saya? itu awak kena tny kerani laa..takkan file hilang pon saya kena ambil tau?"

not once, not twice!

anyway, this is based from my own experience. i used to practice before so pls dont say tht i knew nothing about court and procedures!

tanpa nama - this is one emotional remark i got. i never insinuated that. but, if you see it that way, and get upset over it, it's your call. that is a far fetch conclusion you get there. and if i'm in court, senang je nak suroh court retract that statement. i see it, this is still 2009, not 2010. i wonder if i were a girl, making tht statement, what would you say.

Tak tau pulak ada peguam macam ko..aku ingat peguam tu serius manjang dengan muka tak senyum orang..

lawyers are always agree to disagree. i have my own opinion, and you have yours. but in the end, we are all members of the Bar.

nak buat aduan ke majlis peguam atau badan kehakiman? kalau kamu peka dengan permasalahan rakan2 peguam dan majlis peguam, kamu seharusnya tahu yang perkara2 tentang deraf, fail hilang dsb tu dah biasa dibangkitkan ketika perjumpaan di antara wakil majlis peguam dan hakim.

saya cuma pengulang/penghurai saja.

farhana, tanpa nama, salwa dan udalia, masalah2 ni kadang2 yang buat ada di antara kita yang tukar profesyen atau portfolio ke conveyancing atau korporat kan? boleh kira dengan jari berapa orang graduan batch kita masing2 yang jadi litigation lawyers :(

piprx, nampaknya ko ni banyak sangat tonton tv lah. sebenarnya banyak lagi peguam yang gila2 macam aku hahahah. yang kat tv tu lakonan je :)
